Operator: Stella Vision, s.r.o, Komenského 361, 908 77 Borský Mikuláš

  1. Introductory Provisions

1.1. These Accommodation Rules, issued by Stella Vision, s.r.o., with its registered office at Komenského 361, 908 77 Borský Mikuláš, Company ID No.: 52206378 (hereinafter referred to as the “Operator”), apply to the provision of accommodation and related services (hereinafter referred to as “services”) at the Design Villa Stella accommodation facility (hereinafter referred to as the “facility”) and governs the rights and obligations of the operator and guests (hereinafter referred to as the “customer”) from the moment the customer checks in at the facility until the end of their stay.

1.2. These Accommodation Rules have been drawn up in accordance with Slovak legislation and applicable regulations concerning the operation of accommodation facilities. They include the Operating Rules for the Pool and Wellness Center, the Fire Safety Rules, the Privacy Policy, as well as other documents made available to guests.

1.3. These Accommodation Rules are an integral part of the accommodation contract pursuant to Section 754 et seq. of Act No. 40/1964 Coll., the Civil Code, as amended (hereinafter referred to as the “Civil Code”), which is concluded between the guest and the operator. The Accommodation Rules are posted on the premises of the facility. Prior to check-in and before using the services at the facility, the guest confirms that they have been made aware of these Accommodation Rules and agrees to comply with them.

1.4. The purpose of these Accommodation Rules is to ensure order, safety, hygiene, and the protection of the health of guests staying at our facility, which offers accommodations in 3 suites and additional services such as a wellness center, swimming pool, fitness center, lounge, game room, and ski storage room.

  1. Price for Accommodation and Related Services

2.1. The customer shall pay the price for the lodging and related services provided by the operator in accordance with the confirmed reservation. If the customer checked in for a stay without a prior reservation (by entering into an accommodation agreement directly at the facility), as well as in cases where the customer did not pay the full price for accommodation and related services at the time of reservation, or in cases where the customer uses additional services at the facility that were not paid for in advance (e.g., wellness), the guest is obligated to pay for these services in accordance with the current price list for individual services, which is posted at the facility. The guest is obligated to pay any outstanding charges for accommodation services upon arrival at the facility, and charges for other services no later than at the end of the stay (check-out). The guest’s stay cannot be concluded (check-out cannot be processed) until all outstanding balances have been paid. The guest is required to review the bill (invoice) at the time of payment at the facility; any billing complaints raised at a later date cannot be considered.

2.2.  If the customer fails to use the services that have been reserved or paid for by the customer for any reason on the customer’s part (early departure from the stay, later check-in date), the customer is not entitled to any financial or non-financial compensation, substitute performance, or damages.

2.3. The Operator reserves the right to individually assess and determine the validity of a customer’s request for a refund for the full amount of reserved and paid-for services that were not used due to serious reasons on the customer’s part (e.g., injury, serious illness, death, and the like); for the purposes of assessing such a request, the customer is required to prove to the operator the existence and duration of the serious reasons (e.g., a hospital admission certificate, a medical report, a death certificate, etc.). The customer has no legal right to compensation in these cases.

2.4. In exceptional cases, the operator may offer the customer accommodations other than those agreed upon, provided they do not differ substantially from the confirmed reservation. The provisions of these rules do not preclude the consumer’s statutory rights.

  1. Terms and Conditions of the Facility

3.1.  The operator will accommodate the guest on the day of arrival, in accordance with the reservation, between 4:00 p.m. and 10:00 p.m. (check-in). If the guest does not check in by 10:00 p.m. at the latest without having previously informed the operator of a later check-in time, the operator is entitled to make the reserved apartment available to other guests. In such a case, the guest is not entitled to a refund of the price paid for the stay, nor to any other financial or non-financial compensation, substitute performance, or damages.

3.2. Only guests who have registered for accommodations may stay at the facility. Registration takes place upon entry to the facility in the guest’s personal presence. To check in, the guest must present an ID card, passport, or other form of identification to the operator upon arrival at the facility. Upon arrival, the guest will receive a master key to the facility and a remote control for the entrance gate. In the event of their loss, the guest is obligated to cover all costs associated with their replacement.

3.4. The guest has the right to park in the unguarded parking lot adjacent to the facility; the operator is not liable for damage to a parked vehicle resulting from damage to or theft of the guest’s motor vehicle, including its parts and accessories (roof boxes, bike racks, etc.) or any items located inside the motor vehicle parked in the parking lot in front of the facility, as this is not a guarded parking lot and no contract for the safekeeping or storage of the motor vehicle is established between the guest and the operator. The provisions of these rules do not exclude the consumer’s statutory rights.

3.5. Upon entering the apartment, the customer, in their own interest, shall inspect the condition of the apartment and its individual fixtures and their functionality, and shall immediately report any defects or deficiencies to the facility operator. For security reasons, customers are required to lock the entrances to the building.

3.6. All areas of the facility, including apartments, balconies, and terraces, are non-smoking areas. A designated smoking area is located in front of the facility’s entrance. The facility operator will inform guests about the smoking area upon request. If a guest violates the smoking ban on the premises, the operator is entitled to a contractual penalty of €100.00, which the guest is required to pay to the operator in cash no later than at check-out. If, as a result of violating the smoking ban in the apartment or any other areas of the facility, damage occurs to the operator’s property and/or to the the life or health of guests or the operator’s employees, the guest is obligated to compensate for the resulting damage in full, including the costs of taking the apartment out of service.

3.7. When using the kitchen, guests are required to maintain cleanliness and order. After use, they are required to return all dishes clean to their proper places. Customers are required to maintain order and cleanliness in common areas, the game room, and the lounge; customers will be billed for the costs of cleaning up any significant messes in these areas.

3.8. In no area of the facility (apartments, common areas, wellness center, lounge, game room, etc.) is it permitted, without the operator’s consent, to make any changes to the facilities or equipment, tamper with electrical or any other installations, or move any equipment.

3.9. Guests are not permitted to use their own electrical appliances in the apartments, with the exception of electrical appliances used for personal hygiene (electric shavers, epilators, etc.) and chargers for cell phones, tablets, or laptops. Commercial video recordings and photographs are not permitted anywhere on the premises without the operator’s consent.

3.10. Guests are not permitted to bring sports equipment from the fitness center or game room, or their own skis, bicycles, scooters, etc., into the apartment. A designated area within the facility may be used for storing skis and bicycles.

3.11. For safety reasons, children under 10 years of age may not be left unattended in the apartments or other areas of the facility without a legal guardian or a person over 18 years of age authorized by the legal guardian.

3.12. Quiet hours at the facility are from 10:00 p.m. to 6:00 a.m. Guests’ behavior during quiet hours must not disturb other guests. Loud television volumes, loud talking, singing, etc., are not permitted. Loud celebrations, parties, and the like are prohibited on the premises.

3.13. Guests may receive visitors at the facility only with the operator’s consent and exclusively outside of quiet hours. Overnight stays by non-guests are prohibited.

3.14. The operator may enter the apartment for cleaning purposes and, if necessary, to repair a malfunction, or to provide emergency medical assistance, or in the event of a suspected violation of these accommodation rules or a serious threat to the facility’s property, other guests, or the health and lives of guests or the operator’s employees.

3.15. In the event of illness, a sudden deterioration in health, or injury to a guest, the guest shall immediately contact the facility operator (in the case of a minor guest, their legal guardian or responsible person) to ensure the provision of first aid and medical assistance, or transportation to a medical facility (doctor, hospital) at the guest’s expense.

3.16. The customer is required to leave the apartment in the same condition as it was at the beginning of the stay. In the event of damage or a change in the condition of the apartment, the customer is required to restore the apartment to its original condition at their own expense before the end of the stay (check-out); otherwise, they are required to reimburse the operator for all costs incurred in restoring the apartment to its original condition.

3.17. The customer must check out by 11:00 a.m. on the last day of their stay (check-out).  If the guest does not check out by 11:00 a.m. on the last day of their stay, the operator has the right to charge the guest for the extended use of the apartment. The charge for extended use of the apartment when checking out by 6:00 p.m. on the last day of the stay is 50% of the price of accommodation services for one day of stay, at the rate applicable for that day; the fee for extended use of the room when the stay ends after 6:00 p.m. on the last day of the stay is 100% of the price of accommodation services for one day of stay at the rate applicable for that day. If the guest has not checked out by 12:00 a.m. on the last day of the stay, the operator is authorized to inventory and remove the guest’s belongings from the apartment and store them at the guest’s expense.
